Starting July 1, 2014 - Smoking In a Motor Vehicle With Child Present Will Cost You

§ 1134b. SMOKING IN MOTOR VEHICLE WITH CHILD PRESENT 
(a) A person shall not possess a lighted tobacco product in a motor vehicle that is occupied by a child required to be properly restrained in a federally approved child passenger restraining system pursuant to subdivision 1258(a)(1) or (2) of this title. 

(b) A person who violates subsection (a) of this section shall be subject to a fine of not more than $100.00. No points shall be assessed for a violation of this section.

Starting July 1, 2014 a new Vermont law will be in place to protect children in car seats from secondhand smoke. Act 135 bans smoking in motor vehicles when occupied by children in a child passenger restraining system such as a car seat or booster seat. This is a primary offense and punishable by up to a $100 fine.

The Vermont Department of Health advises that public awareness is vital to the law’s success: Our goal is not to fine and ticket but to change the acceptability of smoking around children and protect those who cannot protect themselves.

Children are especially vulnerable to secondhand smoke, which causes respiratory illnesses, ear infections, and lasting damage to a young child’s developing organs and immune systems.
